The U.S. Senate Appropriations Committee approved a fiscal 2013 spending plan for NOAA on Thursday that includes an amendment to close the Northeast regional office of the National Marine Fisheries Service in Gloucester and move the bulk of fisheries management, administration and law enforcement to Silver Spring, Md.

Federal lawmakers from Massachusetts vowed a fight to keep open the NOAA’s NMFS office in Gloucester, which was privately developed and built to specs provided by the General Services Administration. The edifice, the National Oceanic and Atmospheric Administration’s newest and spiffiest regional headquarters among eight Office 2011 MAC Key, sits in Blackburn Industrial Park, is assessed at nearly $13 million, and brings the city $169,185 a year in taxes.

The amendment was sponsored by Sen. Barbara Mikulski, chairwoman of the Appropriations Committee’s Subcommittee on Commerce, Science, Justice and Related Agencies. The Maryland Democrat said the region’s federal waters are vast, extending from Maine to North Carolina and “we in the Bay (Chesapeake Bay) don’t get calls back … This office provides problems at many levels.”

“Better centrally locating the facility at NMFS headquarters would allow for greater coordination with senior management at NOAA and the Department (of Commerce), while saving an estimated $1.8 million on rent and a yet unspecified amount on travel costs,” the Mikulski subcommittee said in its markup. The budget flew through the full committee.

Whether the amendment survives Senate floor action later this year is uncertain; so are the chances of the Mikulski amendment in the House, where if faces a Republican majority. The federal budget year runs from Oct. 1 through Sept. 30, so federal fiscal 2013 begins this fall.

Opposition to the shutdown of the regional office in Blackburn Industrial Park, which according to the subcommittee markup of the NOAA budget, “may leave a small local presence in the area,” was voiced immediately by both U.S. senators from Massachusetts, by Rep. John Tierney, whose district includes Cape Ann, and former Mayor John Bell.

“It would be insane” to abandon Gloucester for the D.C., area, said Bell Buy windows 7 key, who dedicated much effort in his third term as mayor to convincing NOAA to finance construction of the $14 million regional headquarters.

“As many times as we disagree with them,” said Bell, “it is essential to have close access to the agency. There is not a fisherman who hasn’t traveled to Blackburn to untangle things.

“Having NOAA handy is vital to have this fishery work in the long term. Efficiency could be very costly,” Bell added.

Mayor Carolyn Kirk could not be reached for comment Thursday.

“I strongly oppose any effort to close the NMFS regional office in Gloucester and I trust Sens. (John) Kerry and (Scott) Brown will be fighting against this misguided effort and making clear the many reasons why this office should remain open,” Tierney said. “Last year, I voiced my strong objection to Senate language requiring a full analysis on relocating the Northeast regional office closer to NOAA’s headquarters. This analysis has not even been shared with Congress yet, but this hasn’t stopped Senate appropriators from pressing ahead with trying to close the regional office.”

NOAA’s failure for multiple years to produce the analysis Mikulski had requested is said to have convinced her to press the point with her amendment.

“I understand the tensions are still there, but the issue here is Massachusetts jobs and direct access for our fishermen to the regulators whose actions affect their lives,” said Kerry. “At a time when we need more face-to-face communication to improve trust and basic efficiency between federal regulators and our local industry, moving personnel away only creates another bureaucratic hurdle we simply can’t afford. I plan to ask the Appropriations Committee to fix this, and I hope they will accommodate my request.”

“I am disappointed the subcommittee would recommend closing the Northeast regional office at such a critical time for New England fisheries McAfee Product Key,” said Brown. “NOAA is already too disconnected from our fishing communities. Moving their New England staff to headquarters in Washington can only make the situation worse.”

Federal Treasurer Wayne Swan was quick to take some of the credit for the Reserve Bank of Australia's (RBA) dramatic interest rate cut by linking it to the government's budgetary discipline.

The reduction in the cash rate on Tuesday to 3.75 per cent, from 4.25 per cent, following the RBA's monthly board meeting was bigger than expected and welcome news for borrowers – as well as a government plagued with political scandals just a week out from its annual budget.

“Today's interest rate cut and the two before have been made possible by disciplined fiscal policy delivered by this government,” Mr Swan said.

If the cut is passed on in full by the retail banks, homebuyers with an average $300 Tattoo Machines Kits,000 mortgage will save around $96 per month on their repayments.

There was no immediate response from the major banks to the rate cut.

But Mr Swan said the “very profitable” banks had the capacity to pass it on in full.

“Their customers will be very, very angry with them if they do not pass through this rate cut,” the treasurer said told reporters in Canberra.

“Everyone out there has been hanging out for this rate cut.”

It was the first cut in the cash rate since 25-basis-point reductions in November and December 2011.

But in the interim the retail banks have increased their lending rates, citing rising funding costs of offshore markets where access to credit remains tight.

Asked if the upcoming budget would give the RBA room to cut rates further Tattoo Guns, Mr Swan said the government had made it clear it wanted to return a surplus and continue to build surpluses after that.

“That will be a matter for the Reserve Bank at the time and its assessment of all the other factors in the economy as well, including the inflation rate,” he said.

Unsurprisingly, opposition treasury spokesman Joe Hockey disagreed with Mr Swan's claim the rate cut stemmed from the Labor minority government's fiscal policy.

“This is in no way an endorsement of the government's management of the Australian economy. In fact, the Reserve Bank has moved dramatically because of the government's incompetent management of the Australian economy Tattoos Guns Kits,” he told reporters in Melbourne.

The RBA reduction was the largest single cut since the depths of the global financial crisis in February 2009 and comes just a week after the release of benign official inflation numbers.

Hollande, whose election comes as the euro zone is teetering back into crisis with fears about Greece’s future in the single currency, will give his first presidential news conference in Berlin in the evening, flanked by the centre-right Merkel.

His first words as president will be keenly watched by financial markets eager for reassurance that his push to tack pro-growth instruments onto Europe’s budget discipline treaty will not sour the start of his relationship with Merkel.

Any indications on initial economic policy moves will also be scrutinized both outside France and inside, where frustration over rampant unemployment and a sickly economy were key factors behind conservative Nicolas Sarkozy’s defeat.

Today, a court in San Francisco heard arguments about one of the most contemptible legal claims advanced in decades: that Vaughn Walker, the federal judge who voted last spring to strike down California’s ban on gay marriage, was too gay to decide the case fairly.

The claim brought by ProtectMarriage, the group that sponsored the 2008 ballot initiative, tries to shimmy around a direct assertion that Walker’s homosexuality should disqualify him from having judged the Prop 8 case. They don’t say that Walker, who retired from the federal bench last February following his Prop 8 ruling, is biased in favor of gay marriage because he is gay. Instead ProtectMarriage argues—see   this April 25 motion to vacate Walker’s ruling—that Walker, who has lived with his partner for 10 years, may have ruled for gay marriage so that he himself could get married and someday enjoy the benefits of marriage. The motion to vacate is thus rooted in their argument that “no judge is permitted to try cases where he has an interest in the outcome.” And since “no one would suggest that Chief Judge Walker could issue an injunction directing a state official to issue a marriage license to him, yet on this record, it must be presumed that that is precisely what has occurred,” his ruling, they insist, must be scuttled. 

The problem for the proponents of Prop 8 is that there is no evidence in their motion that Walker ever sought to marry his partner, despite the existence of a decadelong relationship. So they rely instead on the argument that he is gay, and that’s enough.

Although rumors that Walker was gay   had been floated—and largely ignored—at the start of the Prop 8 hearing, Walker confirmed, following his retirement, that he was in a committed relationship with another man. He added at the time that he never considered that a reason to recuse himself from the case.

The hearing today took place in the courtroom of Chief Judge James Ware, who took over the Prop 8 case after Walker’s retirement. Both were George H.W. Bush appointees. Ethics experts were quick and nearly unanimous in opining that this effort to overturn Walker’s decision on the basis of his relationship is specious as well as desperate. No claim that a federal judge should have been barred from hearing a case because of race, gender, or religion has ever succeeded Tattoo Supplies, a point made by California Attorney General Kamala Harris in her brief opposing the motion to vacate this ruling: “Just as every single one of the attempts to disqualify judges on the basis of their race, gender, or religious affiliation has been rejected by other courts, this Court should similarly reject Defendant-Intervenors’ effort to disqualify Judge Walker based on his sexual orientation.”

Still, just because a legal argument is degrading and futile doesn’t mean nobody will make it. For as long as there have been bigots in America, litigants have tried to argue that women are too womanly to decide gender cases and that Jews are too Jewish to hear cases involving the first attacks on the World Trade Center. Like ProtectMarriage, these litigants also have tried to dress up their claims as something other than pure bigotry. They never prevail.

The federal recusal statutes provide that judges should be disqualified in cases in which they are actually biased, and also in cases in which their impartiality might reasonably be questioned. As Sherrilyn Ifill wrote in The Root, the effort to besmirch Judge Walker’s integrity is eerily similar to earlier campaigns against black and female judges:

In the late 1970s and early 1980s—as a bumper crop of minority federal district judges appointed by President Jimmy Carter presided over employment-discrimination cases brought under Title VII of the Civil Rights Act of 1964—recusal motions were filed by defendants seeking to remove black judges from hearing these cases. Black judges pushed back firmly against attempts to question their impartiality and framed what has become the universally accepted understanding among the bench and bar: that judicial bias cannot be assumed based on the racial Tattoo Supplies, gender or other status of the judge.

In one of the most pathetic such efforts, cited by Ifill, litigants in 1975, representing the law firm of Sullivan & Cromwell, attempted to bounce federal district judge Constance Baker Motley off a suit brought by female lawyers at the firm alleging gender discrimination. The firm argued that Motley would be biased as a woman, an African-American, and a former civil rights litigator. Motley’s response is as true for Walker today as it was for herself in 1975: “If background or sex or race of each judge were, by definition, sufficient grounds for removal, no judge on this court could hear this case, or many others, by virtue of the fact that all of them were attorneys, of a sex, often with distinguished law firm or public service backgrounds.”

Federal District Judge Leon Higginbotham was faced at about the same time with a motion demanding that he too recuse himself from a case involving African-American plaintiffs claiming discrimination. He replied that “[white] litigants are going to have to accept the new day where the judiciary will not be entirely white and where some black judges will adjudicate cases involving race relations.” Opponents of gay marriage will similarly have to accept the reality that gay judges are no more “biased” than heterosexual ones.

My kids are in their early and late teens and have watched this behavior for years. They know she means well, too, although she certainly can’t accept any criticism. Is there a response that I can give my sister that will show my kids that their mother is 1) not cruel but 2) fed up with the snarky remarks?

Emily Yoffe: How does your sister mean well? She sounds like she enjoys insulting other family members. Since your kids are old enough to understand the dynamics here, have a discussion with them in which you say it’s possible to love people but also dislike parts of their personality. Then when she comments on your hair or shoes or accessories, you can say something like, “Hey, it’s Stacy London! Thanks for the advice, but I’d prefer just to catch up with you and not feel like I’m on an episode of What Not to Wear.”

Every year I get more and more offended, as this is not a “gift” to anyone except themselves, as they get a tax deduction. My kids understand about giving to charity, but I cannot explain how this is a “gift” to us. I would like to tell this person to please stop sending these donations as “gifts” and only a card is fine.

Emily Yoffe: What a good lesson for the kids! A family member makes a contribution in your family’s name to a wonderful cause, and you want your children to understand this isn’t really a gift but a tax deduction, and you want to demand a refund from the giver. Unless you have some moral objection to helping the poorest people in the world obtain farm animals, be a good example to your kids and tell them this is a generously spirited gift and have them help you write a thank-you note.

Northern Va.: One of my best friends and his kids just left after a long visit—single dad, 11-year-old boy, and 4 year-old girl. My husband and I have a 4-year-old boy.

Our friend’s ex is a horrible parent who allows a lot of dreadful behavior, and the stepfather is no help.

We only get to see our friend when he brings his kids (he lives in Florida). But honestly, we simply can’t do this again. The kids are horrible. They scream, break things, refuse the food they are offered, complain, interrupt, contradict, and lie. Our son’s behavior after one of their visits is problematic for a few days.

Finally, our friend really feels that it is not appropriate for my husband or me to say anything. We don’t think we have a right to discipline the kids, but we think we should at least be allowed to say, “Hey, that was rude, and I don’t like it” when a kid spits out his juice because it has pulp in it.

Any ideas for us for approaching our friend?
